If it was:
- Installed legally at the time
- Complied with the regulations in force when it was installed
Then it is generally considered “existing compliant” and does NOT need to be upgraded to meet current Building Regulations.
However (even for old systems) you must comply with current regulations (especially Approved Document J and Approved Document L) if you:
- Replace or upgrade the boiler
- Replace or relocate the oil tank
- Make significant alterations
Even if it’s old, action may still be required if:
It’s Unsafe
- Building Control or an engineer can require upgrades if there’s a risk (fire, leak, fumes)
- Safety always overrides “grandfather rights”
Environmental Risk
- Oil tanks near drains or watercourses may need upgrading under environmental guidance
Property Sale / Insurance
- Surveyors or insurers may require improvements (not strictly Building Regs, but practically important)
