Typically, under the conditions of a tenancy agreement a tenant cannot serve a notice of termination of the tenancy which expires during the initial period of the tenancy.
However, the landlord may in principal accept the Surrender of your tenancy during the initial period of the tenancy subject to them (or their agent) finding a suitable replacement tenant. Until a replacement tenant is found and a tenancy is granted, you would remain liable for:
* Payment of rent
* Payment of Council Tax (or any other similar charge replacing the Council Tax)
* Payment of all associated charges in respect of the use and supply at the property of any telephone service, electricity, gas, oil and any other relevant fuels, water and environmental services.
Where a landlord accepts the Surrender of the tenancy during the initial period of the tenancy and a replacement tenancy is granted, your liability rent, Council Tax and services and utilities would cease on the day before any replacement tenancy starts. Under certain circumstances the Surrender may be executed as a deed i.e. a document that must be signed and witnessed.
Finally, where a landlord accepts the Surrender of the tenancy during the initial period the landlord would typically expect the outgoing tenant to cover at least some of the costs of ending the tenancy and granting a replacement tenancy e.g. cost of compilation of an Inventory and Schedule of Condition Report – a cost that the landlord would not have otherwise incurred during the agreed fixed term.
